A termination letter, a resignation and the end of a fixed-term contract can all lead to the same immediate question: what should you do with the Agentur für Arbeit?

Start by separating three actions: registering as a job seeker, registering as unemployed and completing the Arbeitslosengeld application. The BA presents these as distinct steps. 1. Register as a job seeker: Arbeitsuchendmeldung

Register as soon as you know your employment will end. The deadline depends on how far in advance you know:

When you know the end date

Registration deadline

At least three months before employment ends

No later than three months before the end date

Less than three months before employment ends

Within three days of learning the end date

This also matters when a fixed-term contract is ending: you do not need to wait for a termination letter. The BA allows job-seeker registration online, by telephone or in person. (Bundesagentur für Arbeit: job-seeker registration)

“Within three days of receiving a termination letter” is not the complete rule. If you already know the end date sufficiently early, the three-month deadline applies.

Keep the confirmation and the date you registered.

2. Register as unemployed: Arbeitslosmeldung

Job-seeker registration does not replace unemployment registration. Normally, register as unemployed no later than your first day of unemployment. You can complete this registration up to three months in advance, online with accepted electronic identification or in person. If you register late, payment normally cannot begin before the registration date, even when the other requirements are met. Do not wait for a later adviser appointment. If the office is closed on the relevant day, contact it on its next opening day; the BA checks whether the registration can take effect retrospectively. 4. Does resigning or being dismissed cause a Sperrzeit?

A Sperrzeit is a period when ALG I is not paid because of specified conduct without an important reason. For leaving employment or causing its termination, the ordinary period is 12 weeks, not exactly three calendar months. The law provides shorter periods in certain cases. (§159 SGB III)

The important distinction is not simply who signed the termination letter.

Resignation or an Aufhebungsvertrag: ending your employment yourself or agreeing to end it can trigger a Sperrzeit if you cause unemployment without an accepted important reason.

Employer dismissal: dismissal can still trigger a Sperrzeit where your contractual misconduct caused it and the statutory conditions are met. A dismissal genuinely imposed for operational reasons, without relevant employee conduct or agreement, does not by itself create that job-leaving penalty. Before resigning or signing a termination agreement, clarify the benefit consequences with the BA and obtain independent legal advice where needed. A document labelled “operational reasons” is not a universal guarantee that payments will start immediately.

5. What if your doctor advised you to leave?

The BA's instructions recognise leaving work on medical advice as an important reason. They also require appropriate evidence and allow suitable medical certificates together with the person's explanation. (BA guidance on §159, section 159.7.1(4))

However, a sick note is not automatically proof that resignation was medically advised. The BA must assess the circumstances and evidence. Do not assume that any doctor's letter guarantees exemption from a Sperrzeit.

Discuss the situation with your doctor and ask the BA what documentation it needs, preferably before deciding to leave. Provide an accurate timeline and use the appropriate private channel for medical information. Never invent or alter a medical reason to fit a benefit claim.

6. Why might the BA send a questionnaire?

The Agentur für Arbeit may send a questionnaire or an Anhörung asking why the employment ended. Its instructions provide for investigating the facts, giving you an opportunity to respond and, where necessary, asking the employer for information. (BA guidance on investigating a Sperrzeit)

A request for an explanation is not itself proof that a suspension has already been decided.

Answer the actual questions, check dates against your documents and distinguish what happened from assumptions about why it happened. Explain relevant circumstances honestly and provide the evidence requested. An interpreter can help with the language; assessing the legal strength of your case is a different service.

7. What happens to payments and insurance during a Sperrzeit?

ALG I payments: payment is suspended for the relevant period. This is not necessarily just a delay. Under §148, a Sperrzeit can also reduce the total entitlement duration; a 12-week job-leaving Sperrzeit normally reduces it by at least a quarter. Statutory exceptions apply. (§148 SGB III)

Statutory health and long-term care insurance: where you otherwise qualify and ALG I is unpaid solely because of a Sperrzeit, statutory cover generally continues and the BA pays the relevant contributions. Confirm your individual status with your Krankenkasse. (§5(1)(2) SGB V, Techniker Krankenkasse: insurance during a Sperrzeit)

Pension insurance: the BA does not pay the usual ALG I pension contributions for days when ALG I is suspended by a Sperrzeit. Having health cover is not the same as receiving pension contributions. Ask Deutsche Rentenversicherung how the period affects your individual pension record. (§3 SGB VI, BA information on pension insurance)

Private insurance, missing entitlement or late registration can require a different assessment. A separate suspension connected with severance and an early end to employment must also be distinguished from a Sperrzeit. Not every severance payment causes a suspension. (§5 SGB V, §158 SGB III)

Do not simply assume that “all insurance is paid” or that “all other benefits stop.” The specific benefit and insurance rules need separate checks.

8. Attend required appointments—even during a Sperrzeit

When the BA requires you to attend a reporting or counselling appointment under its statutory powers, take the invitation seriously. The reporting duty can continue while ALG I is suspended. (§309 SGB III)

Missing a required appointment without an important reason, after the relevant warning about consequences, can lead to a one-week Sperrzeit. Late job-seeker registration can also lead to a one-week Sperrzeit. These are different from the usual 12-week job-leaving suspension. (§159(1) and (6) SGB III)

If you cannot attend, contact the office promptly, explain why and ask what evidence or rearrangement is required. Do not assume that silence, an unanswered message or a pending benefit decision cancels the appointment.

For the first employment-counselling meeting, the BA lists identification, a CV, qualification and employment certificates, and application documents among its preparation materials. Keep these together: your employment-end date, registration confirmations, the complete invitation, any questionnaire or decision, and a short list of questions.
